Pocket IMS — Terms & Conditions

1. Introduction

Pocket IMS ("Pocket IMS", "we", "us", or "our") is a software service operated as a sole proprietorship registered with the Federal Board of Revenue of Pakistan (Registration No. 3830386698474). Our registered business address is:

We offer a mobile inventory and point-of-sale management application, an administrative web panel, and a business development officer (BDO) portal, conditioned on your acceptance of all terms, conditions, policies, and notices stated here.

2. Applicability and Updates

By registering for or using Pocket IMS, you agree to be bound by these Terms and Conditions, including the Pocket IMS Privacy Policy, which is incorporated here by reference. These Terms apply to all users of Pocket IMS, including store owners, staff accounts, and business development officers.

In consideration of your use of Pocket IMS, you represent that you are of legal age to form a binding contract and are not barred from receiving software services under the laws of Pakistan or any other applicable jurisdiction.

We may update these Terms and Conditions from time to time. We will update the "Last updated" date above when we do, and continued use of Pocket IMS after changes take effect constitutes acceptance of the revised Terms.

3. The Service

Pocket IMS is a paid subscription software service for retail and pharmacy inventory management. There is no physical shipping involved — access to the service is delivered digitally and activated automatically upon successful payment confirmation from our payment processing partner, Safepay.

4. Terms of Usage

You are prohibited from using Pocket IMS or its content:

• for any unlawful purpose;
• to solicit others to perform or participate in any unlawful acts;
• to violate any federal, provincial, or local laws, regulations, and rules of Pakistan;
• to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
• to submit false or misleading registration or business information;
• to upload or transmit viruses or any other malicious code, or to interfere with or circumvent the security features of the service;
• to attempt to access another store's data without authorization.

We reserve the right to suspend or terminate your access for violating any of the above.

5. Subscription, Payment & Referrals

Subscription fees are charged in Pakistani Rupees (PKR) for the plan duration you select at registration (1/3/6/12 months). All payment collection is handled by our licensed payment processing partner, Safepay, via a hosted checkout page. We do not collect or store your card number, CVV, or full payment credentials at any point. Referral discounts, where applicable, are applied automatically at checkout based on a valid referral code.

6. Refunds & Cancellations

• No refunds for used subscription time. Because Pocket IMS grants immediate digital access to the full service upon payment, amounts already paid for the current subscription period are non-refundable, including if you choose to stop using the service partway through a paid period.
• Cancel anytime. You may cancel at any time from within the app or by contacting us. Cancelling stops future subscription renewals; your access continues until the end of the period you already paid for.
• Billing errors and duplicate charges. If you are charged in error — for example, a duplicate charge for the same subscription period, or a charge processed after you already cancelled — contact us at mohkhan1618@gmail.com or +92 333 6821089. Verified billing errors are refunded to the original payment method within 7 business days of confirmation.

7. Complaints & Dispute Resolution

If you have a complaint about the service or a transaction, contact us at mohkhan1618@gmail.com or +92 333 6821089. We aim to acknowledge complaints within 2 business days and resolve them within 5 business days of receipt. If a complaint cannot be resolved within that time, we will provide you with a status update and an expected resolution date.

8. Intellectual Property

Pocket IMS and its related software, mobile app, admin panel, BDO portal, and content (including images, designs, and branding) are the intellectual property of and are exclusively owned by us. Except as expressly stated herein, these Terms do not grant you any intellectual property rights in Pocket IMS or its related software, and all rights not expressly granted are reserved.

9. Indemnity and Limitation of Liability

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms, or your violation of any law or the rights of a third party.

Your use of Pocket IMS is at your own risk. To the extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for business losses arising from data entry errors, connectivity issues, or third-party service outages (including our payment or SMS providers) beyond our reasonable control.

10. Termination

We may suspend or terminate your access to Pocket IMS, with or without notice, if you: provide false or misleading registration information; interfere with other users or the operation of the service; are the subject of a request by law enforcement or governmental authority; or otherwise violate these Terms and Conditions.

11. Severability and Waiver

If any portion of these Terms is found to be unenforceable, the unenforceable portion will be amended to the minimum extent necessary to make it enforceable, or severed, with the remaining Terms continuing in full force and effect. Our failure to enforce any of these Terms is not a waiver of that term.

12. Governing Law

These Terms and Conditions are governed by the laws of the Islamic Republic of Pakistan, and you agree that the courts of Mianwali will have exclusive jurisdiction in any dispute arising between you and us.
